Overcharge - 2.99 Value Meal

==========================

Location:
4308 Sterling Commerce Drive
Plant City, FL
Phone: 813-659-8603

PLANT CITY, FLORIDA -- On a Sunday in May we went to Wendys for the $2.99 special. I tried several times to speak to the employee about the mistake I thought he made.
He and the manager were very rude and refuse to speak the truth about why they charged me for something I did not order.
On Sunday afternoon I called the number on the back of the receipt and told the lady named Nicole what happened. She told me I should have a response within 2 days.
I also tried to find an Email address to write about what happened. It was hard to find anyone to write to Wendys on the internet.
I found 5 emails to write to. Mr. Rohan Shearer was the only one to write back at that time. I wrote to the ones he referred me to and they took about a week to reply.
Mark Dunn said he emailed me but when I asked him for a copy of the emails he said, "I'm researching these emails as we speak" and suggested I put that question aside.
Christopher Smith said he had tried to reach me. When I asked him how he tired to reach me, he never replied.
In the end they never explained to me how the situation was taken care of or why the employees lied to me.
I never received an apology from the employees.
The managers apologized for the incident but never answered the questions I asked.
They offered me a refund and some coupons to come back and spend more money at their place.

Sunday, May 2, 2010

Me and the 86 year old man that I am taking care of decided to eat at Wendy's off of County Line Road, Plant City, Florida. When Lorenzo asked me for my order, he was difficult to speak to.
I asked for 2 of the 2.99 double burger value meal that was on the big sign on the window. He acted like he was not sure what I was talking about. So I pointed to the sign at least twice and told him I want the 2.99 double burger value meal the was on the top part of the sign.
I also asked for the .99 cent chicken sandwich.
After he took the money, I noticed he rang up a charge for 6.78. I told him again that I wanted 2 of the 2.99 double burger value meals that was on the sign and the charge should have been 5.98 not 6.78.
He tried to tell me that the 6.78 included the tax, then he went to get the manager.
The manager named Anthony came up and tried to tell me the 6.78 included the the 7 percent tax for the meals. Then I tried to ask him what was the .55 tax was for.
Anthony refused to give any correct answer. And he told me at least twice that I needed to call or take that up with the federal government. He also told me to call the number on the back of the receipt.
I kept the receipt and sat down to eat. When I opened the burger I noticed there was neither lettuce nor tomato on the double burger. I went back to the counter and spoke with a nice lady and told her I wanted the lettuce and tomato like the one on the big sign on the window. She was very nice and gave me a new burger with the lettuce and tomato.
Lorenzo and Anthony were very rude and apparently too stubborn to speak the truth concerning the additional .80 we paid for the two 2.99 value meals. 7 Percent of 5.99 should be .42 cents rounded off. That is about half of additional .80 cents I was charged.
I do not like being lied to by employees who treated me like I am too dumb to notice the truth.
I also did not like being told I had to call and take it up with the government for an .80 cent overcharge.
The situation should have been taken care of at Wendy's.
I have been eating at Wendy's since the 1970's and have never had a problem like this.
And because of the deceitful actions of Lorenzo and Anthony, I will not be eating at Wendy's anymore until the company takes care of the situation.

Mr. Kribbs - Thanks for forwarding your concern to my attention. I actually work in the Salt Lake City area and have no oversight for any of the stores in Florida. I am going to copy this e-mail to one of my peers, Steve Dunn, who is the HR Manager for most of Florida. I'm sure he'll forward this to the appropriate party who can address your concerns.

Thanks again.

Mr. Dunn,

It has been a week since the Wendy's incident.
As yet, I have not received any answer to the number I called last Sunday.
The 1-888-624-8140 number is on back of the ticket.
I spoke to a lady named Nicole and she said I should have an answer within 2 days.
I also posted the complaint with the Wendy's website and it said I should have an answer in 2 days.
So far there has not been any answer concerning the Wendy's employees actions.
Would you please let me know why Wendy's employees are overcharging their customers and lying about it?
I can only wonder how many times they have done this to others.

Mr. Christopher Smith,

Thank you for your response. I am not sure of how you have been trying to reach me. The Email way of communication is fine with me.
In your letter you said, " I can see what was the problem."
I am not sure what you meant by this. Were you able to look the video at Wendy's?
You also said, "You may not be a regular customer with me..."
I have been going to Wendy's for over 30 years. And this was the 3rd time I had been at the Plant City Wendy's on County Line Road for the $2.99 special. We have also been there several other times.
I would rather not use my phone number to call for privacy reasons. I would prefer that you communicate with me through the Email concerning this matter.

Mr Michael's,

I'm researching these emails as we speak, putting that aside for now I would really like to really take care of refunding your purchase as well as perhaps send you some coupons for all the inconvenience we have put you through up to this point, if you could either send me a mailing address or have the ability to swing by the unit we could reconcile that portion of the incident as soon as possible.
We as a company continually strive to do the right thing daily, with that being said, we still have opportunities daily we handle, it's usually due to a team member not thinking things through, we identify these through unit visits and observations, equally important for us is when a guest takes the time to also let us know about their experiences, I can assure you we take all comments very seriously and this one is no exception, I have had meetings already with all involved as well as viewing video of that day, I have also given specific guidance to the GM, I don't anticipate this happening at this unit again, I look forward to hearing from you, Thanks, Mark..

To Wendy's

Managers have indicated they were taking care of the situation but did not tell me how the problem "has been addressed".
It seems as if they just want me to accept the refund and coupons without knowing what was said or done about the incident.
They have also apologized for the incident. Although I think apologies are great, they were not the ones who offended me. It was Lorenzo and Anthony who have offended me at my last visit to Wendy's.
I would like to return to Wendy's for many good reasons, but I can't return without knowing how the incident was taken care of.
As far as I'm concerned the best way for me to return is to have Lorenzo and Anthony apologize in writing with an explanation of why they thought it was right to tell me the 6.78 amount included the tax.
If they were to do this, then I would know they were sorry and this would not happen to me again.

Thank You,

Business

=====================
HOLIDAY INN /
210 S. SERVICE RD/WEST MEMPHIS, AR/NIGHT AUDIT
This was a corporate hotel and the managers who worked there were very concerned with guest service. During several meetings we were taught the importance of keeping notes in the hotel log book and to write down anything that happened during the shift even if nothing happened. We were taught Customer Service was the priority there and we were not allowed to lie to the guest because at least 99 percent of the time the guest were right. At several meetings we were taught what to do if someone came to the desk and wanted information about the guest. We were told not to give any guest information to anyone without a court subpoena. They were very serious about this rule and said if anyone gave out guest private information against regulations they would be fired and prosecuted to the full extent of the law.
Protecting Guest Privacy WAS important.
========================
FOUR POINTS SHERATON LAKELAND/ HOTEL & SUITES
4141 S. FLORIDA AVE., LAKELAND, FL /DESK CLERK
When working for the Sheraton the owner would come behind the desk to use the computers to alter the guest files ( folios ). I thought this was very strange as this was the desk clerks job and we had to stand aside so we could not see what information he was changing.
========================
6607 SHADOW WOOD RUN / LAKELAND, FLORIDA 33813
One day a neighbor named Larry Moore came up to me in front of the house and asked me about the Sheraton. I told him how the owner would have us step aside and he would do some things in the guest accounts. I told Larry I did not think this was right. Larry said he was a friend of the owner and said he did think the owner of the Sheraton ran the place well either.
=================
HOLIDAY INN / 4645 N. SOCRUM LOOP RD./LAKELAND, FL. 33809/NIGHT AUDIT
In the Winter 1992 and Spring of 1993 a detective came to the night window and asked me to give him a copy of phones numbers a guest had made from his hotel room. At first I refused but then he show me his I.D. which looked official and he assured me it was legal. I made copies of the guest phone records and gave them to the detective. I wrote about this in the hotel log book. The next morning I asked the general manager if it was legal to do this and she said yes that it was o.k. I also wrote about this in the log book and wrote I was not sure if this was right ( because I was taught different at another hotel).
Weeks later I was forced to sign a strange form concerning what to do if an attendance error were discovered on the housekeeping report late at night. The form said I should call the room to see if anyone was there. If someone answered then I should hang up the phone without saying anything and bill the room for another night. If they called back then I should lie to them and say to them I did not make the call.
After I read the form I said I did not want to sign it for 2 reasons.
1. Any housekeeping errors are suppose to be corrected while
the housekeeper was still on the property. (before the Night shift)
2. I have been taught it was wrong to lie to the guest.
Then I was told if I did not sign the form I would not be able to work there anymore. I signed the form because I did not want to lose my job. I also asked for a copy of this form and was told I could not get one because the copy machine was down. I wrote about this in the hotel log book.
Some weeks later the incident happened. I discovered an error on the housekeeping report about 1:00 or 2:00 a.m. and did what I was instructed to do.
The lady in the room called back and ask if I called the room and hung up. At first I said no. Then she said she knew it was me that called. I then told her the truth and said it was me that called. She sounded upset and I told why I called.
Then one or two days later I was written up for the incident. I told the manger I was following orders according the form I signed. The general manager said she did not know anything about the form I was forced to sign. I said I wrote about this in the log book and she said she the log book was missing. She did not even make an attempt to get out of chair to look for the log book. She just said it was missing.

CONTINENTAL PLASTIC CONTAINER
5200 REGION COURT / LAKELAND, FLA. 33815/UTILITY
While on line 1 during second shift I was having a difficult time with the trimmer. I asked John (SASNETT, JOHN E) for help with the problem. At first he said he could not fix the problem. I tried to think positive and said o.k. I guess I could have fun with it. Then he started to yell and cuss at me and told me I needed to get some pussy. I was surprised and upset. He started to work on the trimmer again then I went to the office and told the supervisor ( I think his named was Steve) I think you need to have a talk with John and told (Steve) what had happened. He said he would have a talk with him.
The next day I was on line 1 again and the grinder at back of the line had clogged up. I went to the back and unclogged the line myself since I was the only one on the line. When I came back to the front the machine (which I am not suppose to be operating) was jamming up with bottles. I started to pull the mess out as fast as I could throwing some bottles in the bin and grinder. When I looked up John and (Steve) were just standing there and asked what I was doing (which should have been obvious). Neither one offered to help.
Later on I was called into the office and written up for what they said was damage of company product. The form had a place for me to write my own comments. I wrote how they were only writing me up because I made a verbal complaint about John. They gave me a copy and I left.
The next day they called back to the office to sign another write up form and said (in their oppressive manner) I could not write about the incident with John on the form. At first I did not want to omit the comment and sign a new form but they were saying things which made me nervous. I did as they said and signed the new form.

WESTWOOD APARTMENT/5975 NEW TAMPA HIGHWAY/LAKELAND FLORIDA 33815/SEPT 1993-JULY 4, 1998
When I first came to this place Sue the apartment manager named told me sheriff Crow owned the property. I did not know who he was so I asked "who is he?". She told me he is the sheriff of Polk County.
At that time I was not concerned with who owned the property. I told her I was looking at the place because it was close to work and I would be able to walk to work if anything happened to my car.
On many occasions neighbors would complain to me about the abusive ways the managers would speak to them and harassed them. I agreed with the wrongful ways they were treated but I did not know what I could do about it. Managers going into tenants apartments when they were not around. The shut off of electricity, bad water being served and not wanting to clean it up. In January of 1998 I came home from work one night and saw the mail being stolen.
In the last months of my residence there I suffered harassment that eventually led to my eviction on July 4th, 1998.

RESIDENCE / LENA AND CARL PADGETT
6607 SHADOW WOOD RUN, LAKELAND, FLORIDA 33813
Had lunch with mother and Carl. Carl spoke about what he thinks is a funny story. When Carl was young, there was a rape of a young white girl. Carl's dad was with a group of men and had caught a black man who they thought did the crime. They took him to the woods and tied him to a tree. Then they tortured him. Someone cut off his penis and shoved it in his mouth then they burned him to death. Carl's dad came home and said, "boys we don't always get the right one but this time we are sure we did". Carl laughs at that part. I have heard Carl speak about this event several times.
After lunch I went to work at Witt Plastics Inc. of Florida.

WITT PLASTICS INC OF FLORIDA / WORKED FOR ONE HOUR
When I arrived to work they had me punch in on the time clock and led me upstairs to fill out some more forms. There were many pages to these forms and on three to these pages were medical release statements. The Statements required the release of all my medical records past, present and future regardless of my employment status with the company. It also said the records could be used against me in a court of law.
When I asked them about the forms they said they really don't do these things. Since their answer did not make much sense to me I decided not to sign the forms. Then they said I could not work there. I asked them if I was being fired. They just said I could not work there. I left the place confused.

I went home and told mother and Carl what had happened. They got mad and started to yell at me saying things like I did not want to work. Carl said those forms were just a formality. He told me to pack my bags and leave. He refused to give me a ride downtown.

Lakeland Public Library
Spring 2001
In the spring of 2001 I was learning to use the Intenet at the Lakeland Public Library. Afterwards I went to take a break outside.
As I was coming out the door, I noticed two things:
(1) a policeman in a police car in the parking lot
(2) a group of kids to the left
I did not want to be around those kids so I went right and around the corner to smoke a cigarette. After a couple of minutes, one of the kids came up and asked me a simple question on directions of how to get to Florida Ave. I thought the question was strange as you could see the street from the front of the Library. I answered his question and he left.
About a minute or two later the policeman pulled up in the car. He came up to me and wanted to see my driver's license. I asked him why? His excuse was he saw me talking to the one of the kids and thought I was hanging around them. I told him was not with the group of kids and that I had been on the Internet in the Library. He asked me what I was doing on the internet. I told him it was a matter of privacy.
The Policeman then asked for my driver's license again so he could do a check for warrants (or something like that). I gave him my license he wrote down the number on what looked like a personal note pad. I questioned him about the note pad and he said he wrote it down so he could call it in. He then asked me for my social security number. I asked him why he needed my social security number. He said he needed it to do a criminal back check. I was nervous being in a corner with him and let him have my social security card. He wrote the number down on his note pad.
He then told me to wait there while he called it in. He went in the car and drove away as soon as he was shut the door. He did not call the information in. I was a little surprised and did not think to much about it then.

2330 WYDINE DRIVE/ LAKELAND, FLORIDA 33801
Saturday November 10, 2001 (About 5 minutes after midnight.
The following is about some of the not so legal ways of the neighborhood watch.
One night while I was sleeping I received a phone call from the head of the neighborhood watch of 2310 Wydine Drive in Lakeland, Florida.
I answered the phone and Calvin said he wanted to talk to John. I quietly said he was asleep. He said o.k. then I'll tell you. I said no and hung up. The phone rang again a few minutes later. I started to get up and answered again but John said no just let it ring. The message machine came on and Calvin left the following message:
YES JOHN AH / THIS IS CALVIN / I GOTTA TALK TO YOU IMMEDIATELY AH
MIKE WAS VERY RUDE AND SMART / I WANT A ASK FOR YOU AND SAID YOU WERE ASLEEP AND HE HUNG UP ON ME. / I DIDN'T ACTUALLY APPRECIATE THAT / AND I THINK I WILL TAKE HIM OFF YOUR LEASE / SO GIVE ME A CALL / OR HE WILL BE OUT EVICTED / THIS WEEKEND / THANK YOU
(HUNG UP)
I stayed in bed and listened to the message he left on the phone. I asked John if I should call the police and he said no just let it go. About 5 minutes later Calvin and a friend of his started to bang on the door. I went to the phone and called 911. John went to the door and when he opened the door Calvin and his young friend barged in an started to yell and threatened to kick my ass.
They made violent threats on my life if I walked out the door.
The sheriff arrived and they left.
The sheriff heard the phone message and said they are wrong. I told the sheriff I wanted to file charges on them. The sheriff reached up and clicked some button on his microphone. He even made excuses for their actions. He said he was going to make a report and never came back. I think the sheriff may have been told what to do before he arrived.

West Memphis, Arkansas

     ======================
     West Memphis, Arkansas
     ======================

I moved to West Memphis, Arkansas in 1982 and began working as a night auditor at the Holiday Inn.
One night around the year 1983 a man came to the front desk and asked for some change to use the phone.
He was a black man with a rude and abrupt manner that made me a little nervous.  He was wearing an army coat and had a small scar on his cheek.  I gave him the change and he went around the corner to use the pay phone.
A few moments later the security guard went through the back office to the general manager’s office and started looking out the window.  I asked the security guard what he was doing.  He told me he was watching a suspicious person parked in a no parking area outside the lobby.  He also said the man on the pay phone was with the car.
I went to front desk and called the police.  I told the lady there was a suspicious man in the lobby and there was a car waiting outside for him.  Then I asked her to send the police.
As I was speaking to her, the man left.
The lady on the phone said since he left there was nothing they could do.  I asked her again if she could send the police anyway.  She let me know since there was nothing they could do then there was no reason to send the police.
When I finished the call to the police, I made an early cash drop 5 minutes after the hour because the insurance company only insured the cash drawer for $50.00.  Then I wrote about this in the hotel log book.
When I came back to work the next night, two of the desk clerks told me to be sure and not to let cash drawer get to full.  They said they read in the evening newspaper that another hotel in the area was robbed.
I called the other hotel and the auditor said he was robbed and described the robber to me.  It was the same man that I tried to call the police about.
The auditor also said the time in the newspaper was about 20 or 30 minutes off.  He was being robbed at the same time I was making an early deposit and was tied to a chair in the process.
I let him know I tried to call the police on the suspicious man when the robber was at the Holiday Inn.
The auditor told me after the thief left, he managed to get lose from the chair and called the police.  Then the police arrested the auditor and accused him of stealing the money.  The auditor spent the night in jail and was charged with the crime.
I was very surprised to hear this.
The auditor asked me if I would speak to the police for him and I said yes.
One or two nights later a policeman came to me at the desk and asked me what happened.  I let him know I tried to call before the robbery and the time I logged the cash drop.
He said he would check the Snoopy for the call for 30 to 45 minutes before and after the times I gave him.
I asked him what a Snoopy is.
He said the Snoopy was the recorder they used to record incoming calls to the police station.
One or two days later my supervisor Diane Tully called me at home and said the police came by the hotel and wanted to talk with me.  She asked for my permission to give them my phone number and address. I said it was fine with me.
Sometime after that my sister called and said the police came by her place to speak with me.  She gave them my address and directions to my apartment at 215 West Danner that was two blocks away from her place.
I let her know they never came by my place.
Sometime later I came to work and was told by the hotel managers that the police came by the hotel again to talk them.  The police told them that me and the other auditor had somehow conspired together to steal the money and made up the story about the robber.
Again I was surprised and this time upset.  I had never met the auditor at the other hotel.
I decided since the police did not have the apparent intelligence to find me then I would go to the police station.
When I arrived at the station I saw the big Snoopy reel-to-reel tape recorder behind the desk.  I noticed the machine was on and let the lady know why I was there.
A police man came to the desk and took me took to another room to fill out the report.
I asked him if they found the phone call that I had made on the Snoopy.
He said they did not find the call.
I asked him if it was working.
He said it was working, they just didn't find the call.
I sat at the table and he brought me a one page form to fill out.
I started writing everything and ran out of writing space on the paper.
I told the policeman I need more paper to write on.
At first he tried to tell it was not necessary to write anymore.
I said I was not finished and wanted more paper.
He brought me one other blank form to write on.
I fill up that page as well and asked the police man for more paper.
Again he tried to tell me it was not necessary to write anymore.
I said I wasn't finished and wanted more paper.
He brought me another blank form.
I finished writing a 3 page report and went home.
Some night later the auditor from the other hotel came to meet me at the Holiday Inn.
He was very happy and thankful for the help.  He said the charges against him were dropped and the police even apologized to him.
We talked for a few minutes then he left.

I was living at Maggie Boals House when I met Mr. Byers and at least 2 of the murdered victims.

I called Tommy Stacy concerning the three kids when he told me who they were.

-----
- The Rev. Tommy Stacy, pastor of Second Baptist Church, said the arrests brought a feeling of relief to the community. But he said they also troubled him because Mr. Echols and Mr. Baldwin had visited his youth group.
- "Had we tried harder, maybe none of this would have happened," Mr. Stacy said. "So, while there's a sense of relief, at the same time, there is a feeling of guilt on my part. We could have reached them."

It has been more than 20 years since 3 Eight-year-olds were murdered.
Victims
The three victims, Stevie Edward Branch, Christopher Byers and Michael Moore, were in the second grade at Weaver Elementary School; each had achieved the rank of "Wolf" in the local Cub Scout pack; and they were best friends.
